Environment (Wales) Act Section 7 and OSPAR: Marine Species

Under the Environment (Wales) Act (2016), Section 7 requires biodiversity lists to be produced. These lists include types of species which are of 'Principle Importance' for the purpose of maintain and enhancing biodiversity in relation to Wales. This list supersedes the duty in Section 42 of the NERC Act 2006. In addition to this marine species can be protected under the OSPAR Convention. The OSPAR convention has established a list of 'threatened and/or declining species and habitats' in the North-East Atlantic. This spatial dataset details the location of those marine species classed of 'Principle Importance' under Section 7 and are regarded as 'threatened or declining' under OSPAR in Wales. These species include: Alkmaria Romijni tentacled l agoon worm, Anotrichium barbatum bearded red seaweed, Cruoria Cruoriiformis, Edwardsia Timida burrowing anemone, Eunicella Verrucosa pink sea fan, Grateloupia Dermocorynus montagnei, Haliclystus auricula stalked jellyfish, Hippocampus sp., Lithothamnion coralloides Coral maerl, Lucernariopsis Campanulata stalked jellyfish, Arctica Islandica Ocean Quahog, Ostrea Edulis, Padina Pavonica, Palinurus Elephas Crawfish, Phymatolithon calcareum common maerl and Tenellia Adspersa.

The data collation included the use of Marine Recorder to query the plot distribution species. The validity of records were checked. Records that were considered doubtful due to the geographic location and known inexperience of the recorder, were checked thoroughly and excluded if not corroborated. Data layers within this dataset are updated at different times, usually as and when new data is available and collated.

Part of this dataset is sensitive and restricted. The sensitive data is as follows; Ostrea edulis, Palinurus elephas, Hippocampus spp. and cetaceans locations. Sensitive data must be kept confidential; general release is not permitted due to risk of harm to the environment or third parties. Sensitive data may only be released under an appropriate NRW Licence. Requests should be referred to NRW's Access to Information Officer. Data may be released freely if the sensitive records are removed in advance, or shown only at a coarser scale.
