Summary

Section 106 of the Town and Country Planning Act 1990 (including the previous S52 agreements from the 1971 Act) allows a local planning authority to enter into a legally binding agreement or planning obligation with a land developer over a related issue. This obligation is commonly referred to as a 'Section 106 Agreement'.
